1. ACCEPTANCE OF TERMS
By accessing, registering for, or using North Captiva Signal, including submitting information through this website or enrolling in SMS or email notifications, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Use.
If you do not agree to these Terms, you should not use the Service.
2. COMMUNITY PURPOSE
North Captiva Signal is a community-based communication initiative created by members of the North Captiva Island community to improve awareness, communication, and coordination during emergencies and other events affecting the island.
The purpose of the Service is to help residents, property owners, renters, and visitors stay informed by sharing timely information that may assist individuals in making informed decisions during hurricanes, fires, and other situations affecting the island
This Service is intended as a community communication tool created by our community for our community.
Participation is voluntary.
3. DESCRIPTION OF SERVICE
North Captiva Signal is a privately operated communication platform that may provide:
- Emergency alerts
- Hurricane updates
- Fire notifications
- Evacuation information
- Safety advisories
- Community coordination updates
- Two-way messaging capability
- Optional property-related coordination services
- Future island communication services
The Service may use automated messaging technology to send SMS or email notifications.
Message frequency varies.
Message and data rates may apply.
4. NOT AN OFFICIAL EMERGENCY SYSTEM
North Captiva Signal is not a government agency and is not an official emergency alert system.
The Service does not replace:
- 911 emergency services
- Lee County Emergency Management
- National Weather Service alerts
- NOAA weather radio
- Law enforcement or fire rescue communications
Users remain responsible for monitoring official emergency sources and following instructions issued by authorized authorities.
5. ELIGIBILITY
By registering you represent that:
- You are the authorized user of the phone number submitted
- The information you provide is accurate
- You have authority to receive communications regarding the listed property
6. CONSENT TO COMMUNICATIONS
By submitting your mobile number and affirmatively providing consent through the registration form, you authorize North Captiva Signal to send you recurring communications, including automated text messages and emails related to:
- Emergency notifications
- Safety alerts
- Community coordination updates
You may opt out at any time by replying STOP to a text message.
Message frequency varies.
Carrier message and data rates may apply.
Consent to receive communications is voluntary and may be revoked at any time.
7. OPTIONAL ABSENTEE PROPERTY SUPPORT
Users may optionally elect to receive communications intended to assist absentee property owners during emergency situations.
These communications may include:
- Storm proximity updates
- Fire proximity updates
- Situational updates affecting specific areas of the island
- Basic exterior condition observations when safe to do so
- Communication or coordination assistance with local resources
Participation in optional property support services:
- Is voluntary
- Is not required to receive emergency alerts
- May be discontinued at any time
Participation does not create:
- A property management agreement
- A real estate brokerage relationship
- A fiduciary duty
- An agency relationship
Any property management or brokerage services require a separate written agreement.
8. OPTIONAL FUTURE COMMUNITY SERVICES
North Captiva Signal may expand to include additional island-related services such as:
- Community information platforms
- Volunteer coordination
- Island event communications
- Property coordination tools
- Community forums
Participation in such services will require voluntary consent where required by law.
9. USE OF INFORMATION
Information collected may include:
- Full name
- Phone number
- Email address
- Island property address
- Optional service preferences
Information is used for:
- Operation of the Service
- Delivery of notifications
- Community coordination
- Development of future community services
North Captiva Signal does not sell personal data.
Information may be disclosed if required by law or necessary to protect life or property.
10. NO GUARANTEE OF DELIVERY
The Service relies on telecommunications networks and third-party technology providers.
North Captiva Signal cannot guarantee:
- Delivery of messages
- Timeliness of alerts
- Accuracy of all information
- Continuous service availability
Network failures, power outages, infrastructure disruptions, or carrier limitations may prevent message delivery.
Users must not rely solely on the Service for emergency preparedness.
11. USER RESPONSIBILITIES
Users agree to:
- Maintain current contact information
- Monitor official emergency sources
- Follow evacuation orders and public safety instructions
- Maintain their own emergency preparedness plans
12. LIMITATION OF LIABILITY
To the maximum extent permitted by law, North Captiva Signal and its owners, operators, volunteers, contractors, and technology providers shall not be liable for any damages arising from use of the Service.
This includes but is not limited to:
- Personal injury
- Death
- Property damage
- Economic loss
- Business interruption
- Indirect or consequential damages
Use of the Service is voluntary and at the user’s own risk.
If liability cannot be fully excluded, liability shall not exceed the amount paid for the Service in the preceding twelve months.
If the Service is free, liability shall not exceed zero dollars.
13. INDEMNIFICATION
You agree to indemnify and hold harmless North Captiva Signal from claims arising from:
- Your use of the Service
- Your violation of these Terms
- Your reliance on Service communications
- Your failure to follow official emergency guidance
14. PLATFORM EVOLUTION
North Captiva Signal reserves the right, in its sole discretion, to modify, update, or revise these Terms of Use at any time in order to reflect changes in the Service, legal requirements, or operational practices.
Any such modifications will become effective upon posting the updated Terms on the North Captiva Signal website, unless a different effective date is specified.
Where appropriate, we may also provide notice of material changes through reasonable means, which may include:
- Website notifications
- Email communications
- SMS notifications
- Other electronic notices associated with the Service
It is your responsibility to review these Terms periodically.
Your continued access to or use of the Service after updated Terms are posted constitutes your acknowledgment of and agreement to be bound by the revised Terms.
If you do not agree to the modified Terms, your sole remedy is to discontinue use of the Service and unsubscribe from notifications.
15. GOVERNING LAW
Any disputes shall be resolved in courts located in Florida.

- Does not replace official emergency alerts
- Does not guarantee safety or property protection
Messages and communications provided through the Service are informational in nature.
Optional property support communications may include observational updates or coordination assistance but do not constitute professional inspections, engineering services, property management, or brokerage services.
Users remain responsible for personal safety decisions, property protection, insurance coverage, and emergency preparedness.
North Captiva Signal makes no warranties, express or implied, regarding reliability, accuracy, or availability of the Service.
The Service is provided “as is” and “as available”.
Your sole remedy for dissatisfaction with the Service is to discontinue use.
